relating to requiring payment and performance bonds for certain public work contracts.

Summary

Performance and payment bonds above $150,000.

The bill requires the Texas Parks and Wildlife Department to make contractors post a performance bond and a payment bond before starting work on certain public work contracts worth more than $150,000. It touches contractors who take on those department construction-type contracts, plus the subcontractors and suppliers the payment bond protects. Starting with contracts the department solicits on or after September 1, 2025, a contractor cannot begin work on a covered job over $150,000 without both bonds in place.

A BILL TO BE ENTITLED

AN ACT

relating to requiring payment and performance bonds for certain

public work contracts.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 11.0171, Parks and Wildlife Code, is

amended by adding Subsection (a-1) to read as follows:

(a-1) For a contract described by Subsection (a)(2) that is

also a public work contract, as that term is defined by Section

2253.001, Government Code, the director shall require the

$150,000.

SECTION 2. (a) Section 11.0171, Parks and Wildlife Code, as

similar solicitation, on or after the effective date of this Act.

(b) A public work contract for which the Parks and Wildlife

Department first advertises or otherwise requests bids, proposals,

or qualifications, or makes a similar solicitation, before the

effective date of this Act is governed by the law as it existed

immediately before that date, and that law is continued in effect

for that purpose.

SECTION 3. This Act takes effect September 1, 2025.
