Summary

Appeals courts can ask trial courts for findings while an appeal is pending.

The bill lets a Texas appeals court ask a trial court to hear evidence, make findings and offer recommendations while an interlocutory appeal is pending, even when trial proceedings are otherwise stayed. It touches appellate courts, trial courts and parties in lawsuits where one side has appealed a ruling before the case ends. On the ground, appeals courts get a way to gather facts through the trial court when deciding whether to issue temporary orders that protect a party's rights until the appeal is decided.
