Summary

Nicotine or not, vape liquid counts now.

The bill changes the definition of "e-cigarette product" in an existing section of the Health and Safety Code so it covers any substance meant for use in an e-cigarette, whether or not it contains nicotine. This reaches makers, sellers and users of vape liquids that have no nicotine, which the old definition left out. Whatever rules that existing section already sets for e-cigarette products will now apply to non-nicotine vape substances starting September 1, 2025.
