Summary

The Penal Code definition of “firearm” drops them.

This bill changes the Penal Code definition of "firearm" so that less-lethal projectile devices no longer count as firearms. It touches anyone who carries or uses devices built to fire projectiles that temporarily incapacitate a target while minimizing the risk of serious injury or death, as well as police and prosecutors who apply weapons offenses. Starting September 1, 2025, firearm-specific weapons offenses in Chapter 46 would no longer apply to those devices.
