Summary

Model subdivision rules don’t override platting exceptions just outside city limits.

The bill adds one sentence to county platting law saying the state's model subdivision rules under the Water Code do not override exceptions to county platting requirements that apply in a city's extraterritorial jurisdiction. It touches landowners and developers dividing land just outside city limits, plus the counties that review plats there. On the ground, a land division that qualifies for a platting exception in that zone keeps the exception even where the model subdivision rules would otherwise apply.

amended to read as follows:

Sec. 232.0013. CHAPTER-WIDE PROVISION RELATING TO

REGULATION OF PLATS AND SUBDIVISIONS IN EXTRATERRITORIAL

JURISDICTION. (a) The authority of a county under this chapter

relating to the regulation of plats or subdivisions in the

jurisdiction of a municipality.

SECTION 2. This Act takes effect immediately if it receives

a vote of two-thirds of all the members elected to each house, as

provided by Section 39, Article III, Texas Constitution. If this

Act does not receive the vote necessary for immediate effect, this

Act takes effect September 1, 2025.
