Summary

Tax credit applicants get points if every unit has air conditioning.

The bill adds a new scoring factor to how the state housing agency ranks applications for private activity bonds and low income housing tax credits: whether every unit the applicant owns, and every unit run by a partnering housing authority or government body, has air conditioning. Applicants whose units lack air conditioning get negative points, and an applicant asking the local state representative for a support letter must disclose what share of those units have air conditioning. The change hits affordable housing developers and their public housing partners starting with applications under the 2026 allocation plan, with the law taking effect September 1, 2025.
