THE TEXT

“This chapter applies to a consumable hemp product”…

Bill text, introduced version (I)

The caption only says the bill relates to the Texas Food, Drug, and Cosmetic Act. It never mentions that the real change pulls consumable hemp products under that law and strips their protection from being deemed adulterated.

Summary

Caption: just the act’s name. Bill: hemp products can be deemed adulterated.

The bill makes the Texas Food, Drug, and Cosmetic Act apply to consumable hemp products and deletes the line saying a product cannot be deemed adulterated just because it is a consumable hemp product. It touches makers, sellers and buyers of hemp products in Texas, and it also adds a definition of commerce that covers both in-state and interstate trade. On the ground, state regulators could treat hemp products as adulterated under the food and drug law, which the current text forbids.
