Summary

Makes it a Texas offense to have a gun without lawful status.

The bill makes it a Texas offense for a person who is not lawfully present in the United States to possess a firearm. It touches people without lawful immigration status who have a gun, and the state and local prosecutors who would bring the cases. On the ground, this possession becomes a third-degree felony under state law, so state courts can enforce it directly, starting immediately with a two-thirds vote or September 1, 2025 without one.
