Summary

No making, selling or handing out mRNA products to prevent or treat disease.

The bill adds a new prohibited act to the Texas Food, Drug, and Cosmetic Act that bars anyone from making, selling, or handing out a product developed using mRNA material to prevent or treat a communicable disease. It touches drug makers, pharmacies, clinics, distributors, and anyone else in the supply chain for products such as mRNA vaccines, with mRNA material defined as a substance that introduces mRNA matching a viral protein. Starting September 1, 2025, these products could not legally be made, sold, or distributed in Texas, and the state's existing enforcement tools for prohibited acts under that chapter would apply.
