Drafts and emails stay out of public records requests.
The bill widens an existing exception in the Texas public information law so that private notes, emails and draft decisions of hearing judges and technical examiners at the Railroad Commission are shielded from public records requests, the same way those papers already are for judges at the State Office of Administrative Hearings. It touches Railroad Commission administrative law judges and technical examiners, and anyone who files a records request seeking their deliberations or draft orders. Starting September 1, 2025, new requests for those notes, emails and drafts can be refused, while final decisions are not covered by this exception.
