Summary

Drivers 21 or older can’t pay more for sex or marital status alone.

This bill bars auto insurers in Texas from charging a driver age 21 or older a higher premium on a personal auto policy solely because of the driver's sex or marital status. It covers every kind of insurer writing auto insurance in the state, including county mutuals, Lloyd's plans and reciprocal exchanges, and it reaches every adult policyholder. Starting with policies issued or renewed on or after January 1, 2026, a single man and a married woman of the same age can no longer be priced differently on those two factors alone.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter B, Chapter 1953, Insurance Code, is

(b) An insurer may not impose on a personal automobile

solely because of:

(A) the sex of the insured; or

(B) the marital status of the insured.

SECTION 2. Section 1953.053, Insurance Code, as added by

this Act, applies only to an insurance policy delivered, issued for
