Summary

“Substantial bodily injury” becomes a third-degree felony.

The bill adds a new middle tier to aggravated assault in Texas: an assault that causes "substantial bodily injury" becomes a third-degree felony. It defines that injury as one causing protracted pain, temporary disfigurement, or temporary loss or impairment of a body part or organ, which sits between ordinary bodily injury and serious bodily injury. People charged with assaults that leave those mid-level injuries could face felony prosecution instead of a misdemeanor for offenses committed on or after September 1, 2025.
