Summary

Any business hosting a sexually oriented performance, alcohol or not, gets the label and the fee.

The bill widens the state definition of a sexually oriented business, a label the caption ties to a fee. Today the label covers nightclubs, bars and similar places that offer live nude entertainment and allow drinking on site; the bill adds any business or commercial enterprise that engages in or hosts a "sexually oriented performance" as defined in Penal Code Section 43.28, with or without alcohol. Starting September 1, 2025, more venues would fall under the label and the fee that goes with it.

THE TEXT

“a business or commercial enterprise that engages in or hosts any activity defined as a "sexually oriented performance" under Section 43.28, Penal Code”

Bill text, introduced version (I)

The bill puts a fee-bearing business label on any venue that hosts a performance the Penal Code classes as sexually oriented, so the label now turns on the content of what is performed there.
