Summary

Show Texas or Texans in a negative light, and the office can deny your rebate.

The bill changes the Texas Music Incubator Program, which gives rebates to music venues and festival promoters. It lets the state office running the program decline to act on any application, or deny one for content it finds inappropriate or that shows Texas or Texans in a negative light, judged by general standards of decency. Venues and promoters seeking these rebates could be turned down for the content they host, at the office's own discretion, starting September 1, 2025.

A BILL TO BE ENTITLED

AN ACT

relating to the Texas Music Incubator Program.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 485.045, Government Code, is amended to

read as follows:

(a) After reviewing applications for a rebate under the

program, the office shall grant rebates to eligible music venues

communities in which the music venues are located or the festivals

are held, as applicable, and to the Texas music industry, including

on or deny a grant application, the office shall consider general

standards of decency and respect for the diverse beliefs and values

of the citizens of Texas.

[ (b) ] (c) As directed by the office, the comptroller shall

issue a warrant for a rebate granted by the office under this

section drawn on the Texas music incubator account.

SECTION 2. This Act takes effect September 1, 2025.
