Guardianship Background Check Bill Reaches People Outside The Household

Verdict: Smells
Why it's charged
Dragnet
The caption targets adults in the household where the applicant lives. The definition also pulls in anyone with regular contact with the ward, even if they live elsewhere, so the checks reach beyond the household the caption names.

relating to mandatory criminal history background checks for all adult members of a household in which an individual seeking guardianship resides.

Summary
Anyone 18 or older with “regular or frequent contact” with the ward counts, wherever they live.
The bill requires the state's judicial branch commission, under Supreme Court rules, to run criminal history background checks on every adult in the household of a person asking to become a guardian, not just the applicant. The commission must send those check results to the probate court at least 10 days before the guardianship hearing. A new definition counts as a household member anyone 18 or older who lives there, has regular contact with the ward, or helps care for the ward, so people who do not live in the home can also be checked.
