relating to the denial by the Texas Commission on Environmental Quality of a renewal permit.

Caption from analyzed text · version I.

Summary

A history of city or county enforcement actions can sink a renewal.

The bill lets the Texas Commission on Environmental Quality refuse to renew a permit if, after notice and a hearing, it finds the permit holder has a history of enforcement actions by a city, county or other local government for breaking local environmental or health and safety rules. It touches companies that hold state environmental permits, including solid waste permits, and the local governments whose enforcement records would now count at renewal time. Local violations at the permitted site or the holder's other permitted sites become a new reason the state may deny renewal, for renewal applications filed on or after September 1, 2025.
