Summary

Back within 120 days, pension recomputed, actuarially reduced.

The bill lets a Texas Municipal Retirement System retiree who goes back to work for the same city within 120 days of retiring choose to restore full membership and prior service credit. When that person retires again, the system recomputes the pension using service from before and after the first retirement, actuarially reduced to account for payments already received. It applies to all current and past TMRS retirees starting September 1, 2025, while retirees who return after the 120-day window keep the existing rule of resuming the same suspended annuity.

to restore to effect the person's membership, including any prior

service credit, special prior service credit, antecedent service

credit, or updated service credit used in determining the amount of

reemploying municipality; and

(3) resume monthly payments of the recomputed annuity

effective beginning with the month following the month in which

employment is terminated with the reemploying municipality.

(f) Monthly payments of an annuity suspended under

Subsection (c) other than an annuity subject to Subsection (e-1)

this Act, applies to a retiree of the Texas Municipal Retirement

System regardless of whether the person retired from employment

before, on, or after the effective date of this Act.

SECTION 3. This Act takes effect September 1, 2025.
