Summary

Prior convictions and the 18-month limit no longer block it.

The bill widens the existing Good Samaritan overdose defense for people caught with small amounts of drugs or drug paraphernalia after calling for emergency help. It strikes the current limits that deny the defense to people with prior drug convictions or deferred adjudication, people who used the defense before, and people who called for help in the prior 18 months. It keeps only two bars: police were already arresting the person or serving a search warrant, or the person was committing some other offense at the time.
