Summary

“A person” becomes individuals, corporations, trusts, partnerships and more.

The bill rewrites the Property Code definitions of "trustee" and "substitute trustee" in foreclosure law. Instead of saying "a person," the definitions now spell out that an individual, corporation, government body, trust, partnership, association or other legal entity can hold the power of sale under a deed of trust. Homeowners, lenders and mortgage servicers see a clearer rule that companies and other entities, not just individuals, can serve as trustee and run a non-judicial foreclosure sale.
