Summary

Unlawful sales call? $500 to $10K per violation, plus court costs and attorney’s fees!

The bill lets any person harmed by a violation of the Texas telephone solicitation law sue the violator for a court order, actual damages or $500 to $10,000 per violation (whichever is greater), plus court costs and attorney's fees. It touches telemarketers and businesses that make sales calls, and it orders state agencies to make sure businesses comply, with the option to make compliance a condition of a state license or permit. On the ground, people who get unlawful sales calls can sue directly under this chapter starting with claims that arise on or after September 1, 2025, and certain state damages-law limits do not apply to those suits.
