Summary

Finish the program, get the expunction within 30 days. No prosecutor consent needed.

The bill requires district courts to grant an expunction, without needing the prosecutor's consent, within 30 days after a person's case is dismissed for finishing a veterans treatment court, mental health court, or pretrial intervention program. It touches people who complete these programs, the courts that handle their cases, and prosecutors, who must now draft the expunction order from information the person supplies. On the ground, these records get cleared automatically and the expunction fees are waived for pretrial intervention graduates too, while probation departments and prosecutors may keep the records only to develop and run those programs.
