Summary

Bars probation and deferred adjudication for certain defendants, including state jail felony cases.

This bill bars any defendant who is an illegal alien from getting probation, which Texas law calls community supervision, including deferred adjudication. It covers judge-granted probation, jury-recommended probation, deferred adjudication, and the probation that state jail felony sentences normally get automatically. Starting with offenses committed on or after September 1, 2025, a defendant who entered the country without inspection or who fell out of legal visa status must serve the sentence instead of being released on supervision.

Fiscal note · version E · April 25, 2025

Excluding individuals from eligibility for community supervision and deferred adjudication community supervision may result in additional demands upon state and local correctional resources, some potentially significant, due to a possible increase in the number of individuals confined at both state and local levels. The fiscal implications of the bill cannot be determined due to the lack of data necessary to identify the number of individuals who would be ineligible for community supervision.
