relating to the approval of a request for the revision of a charter for an open-enrollment charter school.

Caption from analyzed text · version I.

Summary

60 days to block a revision by majority vote.

The bill makes the education commissioner send every charter revision he plans to approve to the State Board of Education, which gets 60 days to block it by majority vote of members present and voting. It touches open-enrollment charter schools seeking changes or expansions, the commissioner, and the State Board. On the ground, charter changes face a new board veto, and the commissioner's deadline to answer expansion requests doubles from 60 to 120 days.

Bill text, introduced version (I)

The caption speaks of approving charter revision requests generally but does not mention that the bill doubles the commissioner's deadline on expansion amendments. That is a real slowdown for charter expansion. Still, it plausibly falls under 'approval of a request for revision,' so this is a weak hit.

A BILL TO BE ENTITLED

AN ACT

relating to the approval of a request for the revision of a charter

for an open-enrollment charter school.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 12.114, Education Code, is amended by

adding Subsection (a-1) and amending Subsection (c) to read as

follows:

(a-1) The commissioner shall notify the State Board of

Education of each request for revision the commissioner proposes to

grant under this section. Unless, before the 60th day after the date

on which the board receives the notice from the commissioner, a

majority of the members of the board present and voting vote against

the revision of the charter, the commissioner's proposal to grant

the revision to the charter takes effect. The board may not

deliberate or vote on any revision to a charter that is not proposed

by the commissioner.

(c) Not later than the 120th [ 60th ] day after the date that a

charter holder submits to the commissioner a completed request for

approval for an expansion amendment, as defined by commissioner

rule, including a new school amendment, the commissioner shall

provide to the charter holder written notice of approval or

disapproval of the amendment.

SECTION 2. The changes in law made by this Act apply only to

a request for approval of a revision to the charter of an

open-enrollment charter school submitted on or after the effective

date of this Act.

SECTION 3. This Act takes effect September 1, 2025.
