Summary
Can’t sue the government, and the premium can’t go up either.
The bill bars home and car insurers from raising a policyholder's premium solely because the policyholder filed a claim for damage or injury caused by a government body, officer, or employee who is immune from being sued for it. It covers every kind of insurer writing personal auto or homeowner coverage in Texas, including county mutuals, farm mutuals, Lloyd's plans, and reciprocal exchanges. Starting with policies issued or renewed on or after January 1, 2026, a driver or homeowner hurt by an immune government actor can file the claim without that claim alone driving up the rate.
