Summary

No fee, monthly DPS scans. All of it waits until January 1, 2028.

The bill makes the state automatically seal the public criminal record of people who finish deferred adjudication probation for most nonviolent misdemeanors, with no fee, if they have no other conviction or deferred adjudication except for a fine-only traffic offense, at least 180 days have passed since they were placed on probation, and they meet the requirements of Section 411.074. Each month the Department of Public Safety must scan its records, flag eligible people who were discharged on or after January 1, 2028, and tell the court, which must then issue the nondisclosure order within 15 business days. People discharged earlier, back to 1993, can ask the department or the court to confirm they qualify, but nothing in the bill takes effect until January 1, 2028.
