Summary

Teachers, librarians and medical professionals lose them. Judges and law enforcement officers keep theirs.

The bill removes the defense that let a person escape prosecution for selling, distributing or showing material harmful to minors if they had a scientific, educational, governmental or similar reason, and it drops educational, medical, psychological, psychiatric and legislative purposes from the defenses in the separate offense involving sexual performance by a child. It touches teachers, librarians, schools, medical and mental-health professionals, and anyone else who could have claimed those justifications, while keeping a defense for judges and law enforcement officers doing their jobs. Starting September 1, 2025, those professional and educational reasons no longer shield a person from prosecution under these two Penal Code sections.
