Summary

Two age categories, under 10 and 10 to 14, become one.

The bill folds two categories of capital murder, killing a child under 10 and killing a child 10 to 14, into one category covering any child under 15, and repeals a sentencing rule in the Code of Criminal Procedure tied to the old split. It touches people charged with capital murder of a child aged 10 to 14, along with prosecutors and courts. Based on general knowledge of Texas law, the repealed rule capped those cases at life without parole, so the death penalty would become an available punishment for those offenses committed on or after September 1, 2025.
