Summary

Refusing to affirm a child’s stated gender isn’t abuse.

The bill changes the Texas Family Code definitions of child abuse and neglect so that refusing to affirm a child's stated gender or sexual orientation is not abuse or neglect. It covers parents, guardians and anyone else responsible for a child's care, custody or welfare, including refusing to use a child's preferred name or pronouns even if the name was legally changed. Starting September 1, 2025, child protective investigators cannot treat that refusal alone as abuse or neglect.
