THE TEXT

“has recorded a mark or brand for the animal under”…

Bill text, introduced version (I)

The caption covers only an electronic brand registry, but this clause makes anyone who records a brand a presumed caretaker in control of the animal under the animal health chapter. That is a new legal presumption the caption does not mention.

Summary

Caption: an electronic brand registry. Bill: record a brand, you’re presumed in control of the animal.

The bill has the Texas Animal Health Commission build a public, searchable online registry of livestock marks and brands recorded with county clerks. It requires clerks to keep electronic records, accept electronic filings, and send cattle and horse brand records to the commission instead of the livestock inspection association. It also sets the next statewide brand re-recording for 2031 and makes anyone who records a brand presumed to control that animal under the state's animal health chapter.
