Summary

Teachers, librarians and doctors lose the purpose defense. Judicial, law enforcement and legislative reasons stay.

The bill removes several legal defenses from two Texas Penal Code offenses: selling, distributing, or showing material harmful to minors, and sexual performance by a child. It touches teachers, librarians, scientists, doctors, therapists, and government workers, who could previously claim an educational, scientific, medical, psychological, governmental, or similar purpose as a defense. After September 1, 2025, only a bona fide judicial, law enforcement, or legislative reason remains as that kind of defense, along with the existing spouse and close-in-age defenses for the child-performance offense.
