Summary

Hazardous chemical lists leave the Public Information Act.

The bill makes tier two forms, the reports that list hazardous chemicals at a site, confidential when a city, county or other local government holds them, and removes them from the Public Information Act. A local government may release a form only if the state commission has already made it public, or if the release names nothing more than a general class of dangerous goods under the 2024 federal Emergency Response Guidebook. Residents who ask their local government what chemicals are stored nearby would get, at most, a hazard class rather than the form itself, starting September 1, 2025.
