Summary

Section 21.06 goes. Sex-ed materials stop calling it an offense.

The bill repeals Section 21.06 of the Penal Code, the state law that makes homosexual conduct an offense. It also removes the lines in two Health and Safety Code sections that tell sex-education and HIV-education materials to describe homosexual conduct as an offense under that section, while leaving the rest of those instructional requirements in place. The offense would come off the books, and state health-education materials would no longer be required to cite it.
