Section 21.06 goes, and sex-ed materials drop the reference.
The bill repeals Section 21.06 of the Penal Code, the state offense for homosexual conduct. It also strikes the lines in two Health and Safety Code sections that tell sex-education and HIV-education materials to say homosexual conduct is a criminal offense under that section, while leaving the rest of those required statements in place. On the ground, the offense comes off the books, and state health-education materials no longer cite it, starting immediately with a two-thirds vote or on September 1, 2025.
