Summary

No portal, no disclosure. And the bill states no penalty for skipping it.

The bill requires landlords of apartment complexes that use an online rent-payment portal to tell tenants how much of their rent goes to the complex's property taxes. After the landlord gets the property tax bill, it must notify tenants and post the complex's total tax bill on the portal, along with each tenant's private percentage figure. Complexes without an online rent portal are not covered, and the duty starts with tax years beginning on or after January 1, 2026.

A BILL TO BE ENTITLED

AN ACT

relating to disclosure by the landlord of a residential multiunit

complex to a tenant of the percentage of the tenant's monthly rent

payment attributable to the property taxes due for the complex.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter A, Chapter 92, Property Code, is

amended by adding Section 92.027 to read as follows:

Sec. 92.027. DISCLOSURE OF PROPERTY TAX AS PERCENTAGE OF

RENT. (a) In this section, "landlord" and "multiunit complex" have

the meanings assigned to those terms by Section 92.151.

(b) This section applies only to a multiunit complex for

which an online apartment portal is maintained for payment of rent.

(c) As soon as practicable after receiving the bill for

property taxes due on a multiunit complex described by Subsection

(b), the landlord shall:

(1) notify each tenant that the information described

by this subsection is available on the online apartment portal; and

(2) publish on the online apartment portal:

(A) the total amount of property taxes due for

the multiunit complex for that tax year; and

(B) for each tenant, in a section of the portal

accessible only to the tenant, the percentage of the tenant's

monthly rent payment attributable to the property taxes due for the

multiunit complex.

SECTION 2. Section 92.027, Property Code, as added by this

Act, applies only to information for a tax year that begins on or

after the effective date of this Act.

SECTION 3. This Act takes effect January 1, 2026.
