Skip the cost-offset step and the rule is voidable for two years.
The bill removes the exemption that let state agencies skip the state's cost-offset rule requirement for any rule they called necessary to protect health, safety, and welfare. It also lets a person challenge a rule as voidable if the agency did not follow that cost-offset requirement, within two years of the rule taking effect. State agencies writing new rules are affected, along with people and businesses who pay to comply with those rules, starting with rules proposed on or after September 1, 2025.
