Summary

No matter how small the dollar loss!

The bill makes damaging, impairing or disrupting a retail gas pump a third-degree felony under the state's criminal mischief law, no matter how small the dollar loss. It touches anyone who tampers with or interferes with a fuel pump at a retail station, along with the stations that own those pumps. Conduct that might now be a low-level misdemeanor based on a small dollar loss would carry a third-degree felony penalty for offenses committed on or after September 1, 2025.

Fiscal note · version I · April 14, 2025

Increasing the penalty for an existing offense may result in additional demands upon state correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement. The fiscal implications of the bill cannot be determined due to the lack of statewide data necessary to identify cases of criminal mischief involving a retail motor fuel pump.
