Summary

No matter how small the dollar loss.

The bill makes it a third-degree felony to impair or disrupt a retail motor fuel pump, no matter how small the dollar loss. It touches anyone charged with criminal mischief at a gas pump, such as tampering with or damaging pump equipment. Conduct that is now a misdemeanor or state jail felony, depending on the damage amount, would carry the higher felony penalty for offenses committed on or after September 1, 2025.

Increasing the penalty for an existing offense may result in additional demands upon state correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement. The fiscal implications of the bill cannot be determined due to the lack of statewide data necessary to identify cases of criminal mischief involving a retail motor fuel pump or electric vehicle charging station.
