THE TEXT

“an eligible surplus lines insurer if this state”…

Bill text, introduced version (I)

The only change is deleting this one class of insurer from the covered list. That exempts surplus lines insurers from the public adjuster section while every other listed insurer type stays covered.

The caption reads like a bill about protecting an insured's right to hire a public adjuster. The only operative change ends the covered list here, which shrinks who has that right.

Summary

Caption: the right to hire a public adjuster. Bill: fewer policyholders have it.

This bill takes eligible surplus lines insurers off the list of insurers covered by the Texas law on a property owner's right to hire a public insurance adjuster. It touches commercial and residential property owners whose policies come from surplus lines insurers, along with those insurers and public adjusters. Starting September 1, 2025, those policyholders would no longer fall under that section, while policies from stock, mutual, county mutual, Lloyd's, reciprocal and farm mutual insurers stay covered.
