The caption promises a limit on assigning students to an uncertified teacher, but the ban only covers teachers who are both uncertified and in their first year. An uncertified teacher with one or more years in the classroom falls outside the rule entirely.

Summary

Only uncertified first-year teachers count. One year in the classroom and the rule never applies.

The bill bars larger Texas school districts from placing a first- through sixth-grader with an uncertified, first-year teacher in a core subject for two school years in a row. It covers districts with 5,000 or more students and their elementary students, teachers, parents and counselors, and it stops schools from getting a general state waiver to skip the rule. A parent and a counselor or administrator can agree to the placement, a student's first year after transferring in does not count, and the education commissioner can waive the rule in extreme circumstances, all starting with the 2025-2026 school year.
