Summary

Applies after a stillbirth or a baby’s death around birth.

The bill requires every Texas hospital with a maternal level of care designation to offer grieving parents counseling and a cooling device, such as a cooled blanket or cradle, after a stillbirth or a baby's death around birth. It also has the Health and Human Services Commission set up a grant program that hospitals can apply to for staff training and cooling devices, plus a program that formally recognizes hospitals that train staff in this care. Starting September 1, 2025, families who lose a baby at these hospitals must be offered these services, and hospitals can seek state grants or donated money to pay for them.

considerate and respectful manner following a perinatal death or

stillbirth; and

(2) obtaining and maintaining a perinatal palliative

care cooling device and training personnel on use of the device.

(c) The executive commissioner by rule shall establish

eligibility criteria and a scoring system for awarding grants under

the grant program to hospitals assigned a maternal level of care

designation under Section 241.182.

(d) The commission may accept gifts, grants, and donations

SECTION 2. As soon as practicable after the effective date

of this Act, the executive commissioner of the Health and Human

Services Commission shall adopt rules to implement Chapter 328,
