Summary

Local enforcement actions count at renewal.

The bill requires the state environmental commission, when renewing a standard air permit for a permanent concrete batch plant, to weigh any civil suit or enforcement action a local government brought against the plant operator under the state's environmental enforcement chapter. It touches concrete batch plant operators, the cities and counties that sue or enforce against them, and the commission that grades their compliance history. Starting with renewal applications filed on or after September 1, 2025, local enforcement becomes part of the operator's compliance record at renewal time.

A BILL TO BE ENTITLED

AN ACT

relating to the consideration of certain local government actions

before the renewal of air permits for certain concrete plants.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter C, Chapter 382, Health and Safety

Sec. 382.051955. STANDARD PERMIT FOR CONCRETE BATCH PLANTS:

(b) In determining whether and under which conditions to

renew an authorization described by Subsection (a), the commission

any other enforcement actions taken by a local government against

the applicant under Chapter 7, Water Code.

SECTION 2. Section 382.051955, Health and Safety Code, as

added by this Act, applies only to an application for a renewal of

an authorization to use a standard permit that is submitted to the

Texas Commission on Environmental Quality on or after the effective

date of this Act.

SECTION 3. This Act takes effect September 1, 2025.
