Summary

Same tax, same or earlier periods. Then the penalties.

The bill changes how the state figures interest and penalties on late taxes, and interest on refunds, by netting a taxpayer's overpayments and underpayments of the same tax for the same or earlier periods before doing the math. It touches every taxpayer who owes or is owed money under the state's tax title, and it makes the comptroller offset overpayments against underpayments in sales tax determinations instead of merely allowing it. On the ground, taxpayers pay interest and penalties only on what they actually still owe after credits, refund interest is figured on the net overpayment, and the bill calls all of this a clarification of existing law.

provided by Section 39, Article III, Texas Constitution. If this

Act does not receive the vote necessary for immediate effect, this

Act takes effect September 1, 2025.
