Summary

Clerks notify owners and refuse to record suspect filings that can’t be backed up.

The bill makes clerks do more when they suspect a fake deed, lien, or property claim. They must notify the named parties and the last known owner, and a county clerk must refuse to record the document if the prosecutor finds probable cause of fraud or the filer cannot back it up. It also requires a deed to be signed in front of two witnesses and notarized before it can be recorded, starting with documents filed on or after September 1, 2025.
