Summary

Rewrites whose history the commission may pull.

The bill rewrites the list of people whose criminal history the Health and Human Services Commission or its inspector general may pull when checking Medicaid providers. Instead of pointing to federal rules, it spells out in state law who is covered: owners of five percent or more, lenders holding five percent or more of a provider's secured debt, corporate officers and directors, partners, and managing employees. Medicaid providers and applicants, and the people who own or run them, are covered by background checks defined in Texas law rather than by cross-reference to federal rules.
