Caption from analyzed text · version I.

Summary

Agents by May 15, companies by July 16, report by September 1.

The bill sets yearly deadlines for the Texas Department of Insurance to request statistical data from title agents (by May 15) and title insurance companies (by July 16), and requires the department to post a summary report of that data on its website by September 1. It also says any title insurance premium rate ordered or adopted that is not already in effect before June 2, 2025, will not take effect, and any new rate must follow this Act. Title agents, title companies, the department and homebuyers who pay title premiums are touched, because a pending rate change is blocked and future rate setting runs on a fixed data calendar with a public summary.

Fiscal note · version H · April 28, 2025

The fiscal implications of the bill cannot be determined due to effects dependent on the implementation date of the bill. Passage of the bill would allow a title insurance company or agent to continue to charge the premium rates in effect on the effective date of the bill until the Texas Department of Insurance takes certain action based on information submitted to the agency as required by the bill. If the bill takes effect September 1, 2025, there would be no effect on premium tax revenue. If the bill takes effect immediately upon enactment, provisions of the bill would prevent the 10 percent reduction in title insurance basic premium rates ordered by the commissioner of TDI, effective July 1, 2025, from taking effect and premium tax revenue would be increased.
