Summary

The seller or its affiliate must own an out-of-state distillery.

The bill rewrites the state rule that lets an out-of-state liquor seller make an operating agreement with a Texas distillery. Under the new wording, the seller qualifies if it owns an out-of-state distillery and holds a distiller's and rectifier's permit, or if its affiliate does. A qualifying seller can then make, blend, bottle and label its spirits at the Texas distillery and sell them to Texas distillers and wholesalers, starting September 1, 2025.
