THE TEXT

…“the disbursement of accumulated sick days of retired employees.”

Bill text, introduced version (I)

The bill orders retirees' sick days moved into a shared bank, but Section 2 says it does not preempt any existing school policy on those same days. Any district or charter school that already has such a policy can keep it, which weakens the transfer the caption advertises.

Summary

Retirees’ unused sick days go to a shared bank. Unless the school already has its own rule.

When a public school or charter school employee retires, the bill sends their unused sick days into a sick leave bank. Any school district or charter school employee who has used up their own sick days may draw from that bank, subject to the school's existing policies. A separate section says the bill does not override any existing local policy on what happens to retired employees' saved sick days, so schools with their own rules can keep them.

AN ACT

relating to a sick day pool of school employees in the state.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 22.003, Education Code, is amended by

adding Subsection (g) to read as follows:

(g) The accrued sick leave days of an employee of a school

district or charter school, upon retirement, shall be transferred

into a sick leave bank. This bank may be used by any school district

or charter school employee who has exhausted their granted sick

leave days, subject to any existing policies implemented by the

school district or charter school.

SECTION 2. This section shall not preempt any existing
