Summary

It was a Class C misdemeanor.

This bill raises the penalty for the existing Texas offense of making a firearm accessible to a child from a Class C misdemeanor to a Class A misdemeanor. It touches gun owners and other adults whose firearm is left where a child can get it, as defined in the existing section the bill amends. Every violation becomes a Class A misdemeanor for offenses on or after September 1, 2025, and the bill repeals the separate subsection that had set different treatment for some cases.
