Summary
Subsection (d) stops applying to some tax credit housing.
The bill adds one sentence to the state zoning law saying that Subsection (d) of Section 211.006 of the Local Government Code does not apply to certain properties. It covers properties with housing developments that have applied for or received tax credits under the state housing tax credit program run by the Texas Department of Housing and Community Affairs. Those tax-credit projects would no longer be subject to that Subsection (d) step when zoning is changed, and the change starts right away with a two-thirds vote or on September 1, 2025.
