THE TEXT

…“unless the executive director provides otherwise in the authorization to use the standard permit”

Bill text, introduced version (I)

The new hour limits are defaults the executive director can override in any plant's authorization, with no stated standard. That open-ended override sits beside the tightly limited five-day and emergency exceptions and can swallow them.

Summary

Default hours “unless the executive director provides otherwise” for a plant. No standard given.

The bill changes the standard air permit for concrete batch plants so applicants must list their planned daily operating hours and truck hours along with the plot plan. It sets default limits: the plant may run only between 7:00 a.m. and 7:00 p.m., and trucks may haul material at the site only between 5:00 a.m. and 9:00 p.m., with up to five special-hours days a year, emergency hours, and on-site records of any alternative hours. These limits apply to plant operators and their neighbors, except plants permitted under the separate concrete-plant standard permit in Section 382.051985, and the state environmental agency's executive director can set different hours in any individual authorization.
